Holy DUI, Batman!

So the latest word is that I don’t need to testify tomorrow, that Mr. Idiot decided to plea bargain. I’m still going. I have childcare lined up, and there is still the chance that he could change his mind and go for a jury trial. But it looks like I won’t need to take the stand.

But I found out what his blood alcohol level was. Are you sitting down? Not drinking anything? Don’t want to be responsible for choking or falling into a ditch in shock.

The bastard blew a .291. Let me repeat that for the shock value. A FREAKIN’ .291!!!!! Colorado’s legal limit is (drumroll, please!) .08. Do the math, I’ll wait. Yup, 3 1/2 times the legal limit. How this man is not dead is beyond me. How this freakin’ IDIOT didn’t kill anyone that night is a miracle. My guardian angel was working overtime that evening. I almost took our little Saturn instead of the minivan. If he had hit the Saturn instead of the minivan, it would have totaled the car and my friend and I would have been considerably more injured.

So, let’s see what it takes for someone to blow a .291. As stated on the police report, the man weighs 170 pounds. To blow this level he would have had to drink roughly 14 beers in 1 hour.

If you go to this site, you’ll see .291 isn’t even on the chart for his weight.

Here’s some interesting info:

.02 MELLOW FEELING. SLIGHT BODY WARMTH. LESS INHIBITED.
05 NOTICEABLE RELAXATION. LESS ALERT. LESS SELF-FOCUSED. COORDINATION IMPAIRMENT BEGINS.
.08 DRUNK DRIVING LIMIT. DEFINITE IMPAIRMENT IN COORDINATION AND JUDGMENT.
.10 NOISY. POSSIBLE EMBARRASSING BEHAVIOR. MOOD SWINGS. REDUCTION IN REACTION TIME.
.15 IMPAIRED BALANCE AND MOVEMENT. CLEARLY DRUNK.
.30 MANY LOSE CONSCIOUSNESS
.40 MOST LOSE CONSCIOUSNESS; SOME DIE.
.50 BREATHING STOPS. MANY DIE.

So, needless to say, he’s screwed. The assistant DA said the judge is going to come down hard on him. Good. I can’t believe he’s not dead, I can’t believe he didn’t kill someone. Tomorrow ought to be interesting.

Serves him right. If he would have just pled it out in the first place he probably would have got off easier than he will now that he’s drug it in to court. Jerk.

Here in Quebec the punishment is not nearly severe enough. It is very often the repeat offenders who have had their licence revoked who end up driving anyway and killing someone. I hope they throw the book at him. I hope it hits him in the head, or somewhere else that would hurt more.

Well, depends on the size of the book. Maybe not “American History from the Time of Pangea”, but certainly a middle school text…

But it is going to hurt him.

I am SO GLAD that this all worked out in your favor – a little disappointing that he didn’t get a more stiff punishment, but thankfully it’s all over, no one was seriously hurt and now you can celebrate being able to put it behind you!! Way to be strong the whole way through!

Whaddya think?
